Terms and Conditions

These Terms and Conditions ("Terms") are a legally binding agreement between After Hours IT LLC ("we", "us") and you ("User", "you") governing your access to and use of AlarmMCP — the iOS app, the console at alarm-mcp.com, and the API/MCP server (together, the "Service"). By using the Service you agree to these Terms.

The Service

AlarmMCP lets you — and, if you choose, AI agents or MCP clients you authorize with an API key — create and manage alarms that are delivered to your iPhone through Apple's AlarmKit.

Alarm Delivery Is Best-Effort

AlarmMCP relies on Apple's AlarmKit and push notification infrastructure to schedule alarms and, where needed, re-nudge your device. Delivery can be delayed or fail for reasons outside our control — device state, OS restrictions, network conditions, or an outage of Apple's services. The Service is not a life-safety or emergency alerting system. Do not rely on it as your sole means of waking for anything where a missed alarm would cause serious harm.

Accounts

Sign-in is handled by Clerk. You agree to provide accurate account information, keep your credentials confidential, and accept responsibility for activity under your account. We may suspend or terminate an account that violates these Terms, at our discretion, with or without prior notice.

API Keys and Agent Access

Agent keys (amk_…) let AI agents and MCP clients manage alarms on your behalf. You are responsible for keeping keys confidential and for all activity performed using them. Revoke a key immediately from the console if you suspect it has been compromised. We may rate-limit or restrict API/MCP access to protect the Service.

Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any third party's rights
• Attempt to bypass authentication, probe for vulnerabilities, or scrape/crawl the Service
• Distribute malware or code designed to disrupt the Service
• Impersonate any person or entity, or misrepresent your affiliation with AlarmMCP
• Harvest data about other users, or use the Service to harass or spam another person
• Interfere with or degrade the Service, its infrastructure, or other users' access to it

Violating these terms may result in suspension or termination of your access.

Intellectual Property

All content on the Service that isn't your own data — including the app, console, API, and associated branding — is owned by or licensed to After Hours IT LLC and protected by applicable intellectual property laws. You're granted a limited, non-exclusive, revocable license to use the Service as intended; you may not copy, reverse-engineer, or redistribute it.

Third-Party Services

The Service depends on Apple (AlarmKit, APNs, the App Store), Clerk (authentication), Cloudflare (hosting), and PostHog (session replay). Each operates under its own terms, and we are not liable for their outages, changes, or unavailability.

Copyright / DMCA

If you believe content on the Service infringes your copyright, send a notice to nathanbdaeila@gmail.com including: a description of the copyrighted work, the location of the allegedly infringing material, your contact information, a good-faith statement that the use is unauthorized, and a statement under penalty of perjury that you are the owner or authorized to act on their behalf. We will investigate and, where appropriate, remove the material and notify the party who posted it.

Termination

You may stop using the Service and delete your account at any time — from within the iOS app (Settings → Delete Account) or by contacting us. We may suspend or terminate your access for violating these Terms, for legal or security reasons, or at our discretion. Provisions that by their nature should survive termination — intellectual property, limitation of liability, indemnification, and dispute resolution — will survive.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY GIVEN ALARM WILL FIRE ON TIME.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AFTER HOURS IT LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING A MISSED OR LATE ALARM. As the Service is currently provided free of charge, our total liability for any claim will not exceed the amount you paid us in the twelve months preceding the claim (currently $0, since no fees are charged).

Indemnification

You agree to defend and indemnify After Hours IT LLC against claims arising from your use of the Service in violation of these Terms or applicable law.

Dispute Resolution

Before filing a claim, please contact us at nathanbdaeila@gmail.com with a description of the dispute; we'll try to resolve it informally within 30 days. Any unresolved dispute will be subject to the exclusive jurisdiction of the courts where After Hours IT LLC is domiciled.

Age Requirement

You must be at least 13 years old to use the Service, consistent with our Privacy Policy. If you are under 18, a parent or guardian should review these Terms with you.

Governing Law

These Terms are governed by the laws of the jurisdiction in which After Hours IT LLC is domiciled, without regard to conflict-of-law principles.

Changes to These Terms

We may revise these Terms from time to time; material changes will be reflected by updating the effective date above. Continued use of the Service after a change constitutes acceptance of the revised Terms.

General Provisions

• Entire agreement: these Terms and our Privacy Policy make up the whole agreement between you and us regarding the Service.
• Severability: if any provision is found unenforceable, the rest remains in effect.
• Waiver: our failure to enforce a provision isn't a waiver of it.
• Assignment: you may not assign your rights under these Terms without our consent; we may assign ours, including in a merger or sale.
• Force majeure: we're not liable for delays caused by circumstances outside our reasonable control.
